Bar Council of India assures Delhi High Court of looking into request to make RTE Act compulsory subject for LLB

The Bar Council of India (BCI)has apprised the Delhi High Court that it will look into demand of Right of Children to Free and Compulsory Education Act, 2009 (RTE Act) to be made a compulsory subject in all law schools across the country for LLB.

The statement was made by the counsel appearing for the BCI before a bench of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad.

After recording the statement, the bench disposed of a public interest litigation (PIL) petition seeking the said relief.

The petition had been filed by an organisation named Social Jurist through advocates Ashok Agarwal and Kumar Utkarsh.

It stated that even though the RTE Act came into force a long time back but hardly any student, lawyer or even judge is aware of its provisions.

The petitioner organisation said that they have made representation to the BCI as well as several other authorities on the issue but the matter is yet to be decided.

The plea said that perhaps much of the blame for the current inaction regarding violations of the right to education is because law students and lawyers are taught nothing about the right to education. Infact, majority of them are unaware about the fundamental of the rights incorporated in the RTE Act, 2009,’
