Allahabad High Court refuses relief to DP Yadav

The Allahabad High Court has refused relief to Bahubali Dharampal Singh alias DP Yadav.

The petition has been filed seeking cancellation of the ongoing criminal case against him in the MP/MLA special court in Moradabad.

A single-judge bench of Justice Dinesh Kumar Singh passed this order while hearing an application under Section 482 filed by Dharampal Singh @ DP Yadav and Another.

The petition under Section 482 CrPC has been filed seeking quashing of the order dated 8.12.2020 and the entire proceedings, arising out of Crime under Sections 147, 353 and 341 IPC and Section 7 Criminal Law Amendment Act, pending in the court of Additional Seasons Judge, MP/MLA Court, Moradabad.

AGA J.B. Singh submitted the case in question is at advanced stage of the trial and the date has been fixed for recording the statement of the accused.

He further submitted that statements of some of the accused have already been recorded and statements of a few accused under Section 313 CrPC are to be recorded.

‘Considering the advanced stage of the trial, where the statements of few accused have already been recorded under Section 313 CrPC and even otherwise, the Court would not like to interfere with the ongoing proceedings,’ the Court said while dismissing the petition.
